YuLifeへようこそ。YuLife Japan合同会社（会社法人等番号：0100-03-044277）（登録住所：東京都千代田区内幸町2丁目2番2号富国生命ビルA&Sフィナンシャルアドバイザリー株式会社内）（以下「当社」又は「YuLife」といいます。）は、日本で設立された会社です。当社は、お客様のプライバシーを保護し、尊重することをお約束します。当社の使命は、より健康的なライフスタイルを促進することにあります。また、当社は、福利厚生並びに従業員のエンゲージメント及びリワードをすべて一つのプラットフォーム上でご提供しています。

本プライバシーポリシーでは、以下の事項についてご説明します。

お客様が当社のサービスをご利用になる際、当社のモバイルアプリ（以下「YuLifeアプリ」といいます。）や、当社のウェブサイト（現行アドレス：https://japan.yulife.com/saas）上の「メンバー」及び「HR」ポータル（以下「YuLifeポータル」といい、YuLifeアプリとYuLifeポータルを総称して「YuLifeプラットフォーム」といいます。）を訪問し、利用された場合又はお客様が当社にご連絡された場合等、当社がお客様（又はその他の方）とのやり取りを行う際に当社が取得した個人情報を利用する目的及び方法について。

お客様の個人情報については、当社が管理者となり、お客様の個人情報の利用目的及び方法を決定します。当社の連絡先及び会社情報については、本プライバシーポリシーの末尾をご覧ください。

本プライバシーポリシーは随時変更されることがありますので、定期的に本プライバシーポリシーをご確認ください。本プライバシーポリシーの変更方法等については、第9項（本プライバシーポリシーの変更）をご覧ください。

本プライバシーポリシーの最終更新日は、本プライバシーポリシーの末尾に記載された日になります。

2. 当社が収集するお客様の個人情報

当社は、以下の方法でお客様に関する個人情報を収集します。

お客様が当社に対して提供する個人情報

お客様が以下の行為を行われる際に、当社はお客様の個人情報を取得します。

当社のサービス（YuLifeプラットフォームを含みます。）を利用するための登録又は申込みをされる場合。
当社のサービス（YuLifeプラットフォームを含みます。）上でやり取りを行い、又は同サービスを利用される
場合。
電子メール、電話又は当社のウェブサイト上のチャット機能を利用して当社へ連絡をされる場合。

上記個人情報には、YuLifeプラットフォームを通じてお客様から提供される個人情報も含まれ、お客様から任意に提供されるものになります。また、当社は、お客様がYuLifeプラットフォームに関する不具合を報告された際、個人情報の提供をお願いする場合があります。

お客様から当社に提供される個人情報には、以下の情報が含まれます。

連絡先情報 – お客様の氏名、職場の電子メールアドレス、二次的な電子メールアドレス、生年月日、自宅住所、電話番号及び当社がお客様に連絡を取るために必要となるその他の情報。
雇用情報 – お客様が所属する会社／雇用者の名称・氏名、雇用者の住所、社員番号及びお客様の雇用に関するその他の情報。
アクティビティ情報 – お客様の歩数、YuLifeアプリ内でお客様が作成する「Yumoji」及びYuLifeアプリを通じて（例えばSamsung Healthを通じて）お客様の端末から直接収集されるその他情報。
リワード情報 – お客様がYuCoinと引き換えに取得したリワードに関する情報。
調査及びアンケート回答情報 – 当社の調査及びアンケートに対する回答（特別カテゴリーのデータの開示が含まれることがあります。）。
問合せ情報 – お客様からの連絡／問合せに含まれる情報及びこれに関連する情報。
端末情報 – （お客様のモバイル端末のGPS信号又はWIFI信号から取得される）お客様のジオロケーション情報、IPアドレス、MACアドレス及びお客様のモバイル端末から収集されるその他の情報。

当社が上記情報を取得できない場合、お客様は、YuLifeプラットフォームの一部の利用ややり取りを行えず、また、当社のサービスを十分に活用することができず、又は当社と効果的に連絡を取ることができないことがあります。

お客様について収集する個人情報

当社は、お客様のYuLifeプラットフォームへの訪問回数及び滞在時間、お客様がどのページを訪問されたかについての詳細情報等、お客様のYuLifeプラットフォームの利用に関する情報を自動的に収集することがあります。当社は、これらの情報がお客様に紐付けられないよう匿名化します（以下「匿名化情報」といいます。）。

また、当社は、統計目的でホストサーバーが収集する匿名データ、お客様のコンピューター又は端末をインターネットに接続するために使用されるIPアドレス、ブラウザの種類及びバージョン、タイムゾーン設定、ブラウザのプラグインの種類及びバージョン、OS及びプラットフォーム、並びに、クッキー、トラッキングピクセル及びビーコン検知情報及びお客様の端末から収集されるその他の情報等の技術的な情報（以下「技術情報」といいます。）も自動的に収集します。詳細については、当社のウェブサイトプライバシーポリシー及びクッキーポリシーをご覧ください。

当社は、収集した技術情報及び匿名化情報を、YuLifeプラットフォームがどのように作動し、どのようにユーザーに利用されているかを分析するため、洞察するため、並びに、YuLifeプラットフォームを継続的に維持及び改善するために利用します。

お客様についてその他の情報源から収集する個人情報

当社は、個人情報の保護に関する法律及びその他の日本における適用法令（以下「データ保護法令」といいます。）に従い、お客様に関する以下の個人情報を以下の情報源から取得することがあります。当社は、取得した個人情報を次項に定める方法で利用します。

当社がYuLifeグループ内で共有する情報

当社は、以下の第3項に定める目的のために、本第2項に定める個人情報をYuLifeグループ会社と共有することがあります。本プライバシーポリシーにおいてYuLifeグループ会社とは、YuLife Holdings Ltd（英国で登録された会社）の直接又は間接の完全子会社を意味します。YuLifeがYuLifeグループ会社とお客様の個人データを共有する場合、お客様の個人情報の処理及び管理についてはYuLifeが責任を負います。YuLifeの正式な住所は上記第1項に記載のとおりであり、その代表者名はSam Fromsonです。

3. お客様の個人情報の利用方法及び利用目的

当社のお客様の個人情報の利用目的及び（該当する場合に）当社が依拠する法的根拠は以下のとおりです。

上記に記載の当社が法的根拠として同意に依拠する場合、お客様は、いつでも、当社が上記のいずれかの方法でお客様の情報を利用することへの同意を撤回することができます。詳細については、第8項（お客様の権利）をご参照ください。

4. 当社がお客様の個人情報を開示する場合

当社は、上記の利用目的のために、当社の外部サービスプロバイダー、エージェント及び再委託先（以下「本サプライヤー」といいます。）に対し、お客様の個人情報を開示することがあります。本サプライヤーは、以下のとおりに分類されます。

お客様の情報を本サプライヤーに提供する場合、当社は、当該本サプライヤーが当社に対して提供するサービスのために必要な個人情報に限って開示するものとします。当社は、本サプライヤーとの間で、本サプライヤーがお客様の情報を安全に保管すること、当社の具体的な指示に基づく場合以外には当該情報を利用しないことを義務付ける契約を締結しています。

当社がお客様の個人情報を当該情報の管理者である第三者との間で共有する場合、当該第三者は、当該第三者のデータ保護ポリシーに従って当該情報を他の組織に開示又は移転することがありますが、これにより、以下に詳述するお客様のデータ主体としての権利は影響を受けません。具体的には、お客様が当社に対してお客様の情報の修正、消去又は処理の制限を求めた場合、当社は、当社がお客様の個人情報を共有した第三者に対して当該要請を伝達するよう合理的な措置を講じます。

当社は、以下のとおり、その他の第三者にお客様の個人情報を開示することがあります。

当社の事業若しくは資産の一部若しくは全部を再編、譲渡若しくは取得する第三者、又はその他合併、組織再編若しくは類似の事象の場合。
捜査当局、裁判所、規制当局、政府又はこれらに関連する機関からの要請があった場合を含め、法令上又は規制上の義務又は要請を遵守するために、当社がお客様の情報を開示又は共有しなければならない場合。

5. お客様の個人情報の保管

データ保護法令によって許容される場合、当社は、本プライバシーポリシーに定める目的のために、お客様の個人情報を日本以外の地域に移転することがあります。当社は、お客様の個人情報の日本以外の地域への移転を安全に行うために適切な安全措置を講じています。これらの安全措置には以下が含まれます。

規制当局又は政府が行う宣言（十分性認定、規制等）に依拠すること。
データが送られる第三国が当該宣言の対象ではない場合、関連規制当局又は政府によって承認された標準契約条項に準拠すること。
受領者が国際的なフレームワークに加盟していることを確認すること。
その時点で有効かつ適切な代替措置を講じること。

当社が講じる措置について、より詳細な情報をお求めの場合及び関連書類を入手されたい場合、本プライバシーポリシーの末尾に記載する情報を用いて当社にご連絡ください。

お客様が日本国外に滞在中に当社のサービスを利用される場合、お客様の情報は、当該サービスの提供を受けるために必要な範囲で当該地域外に移転されることがあります。

6. お客様の個人情報の保管期間

お客様の個人情報を収集した場合、当社が当該個人情報を保有する期間は、当社における当該情報の利用目的、データ保護法令上の当社の義務等、様々な要因によって決まります。当社は、必要な期間を超えて、個人情報を識別可能な体裁で保有することはありません。

以下に記載する例外に該当する場合を除き、当社は、以下の各個人情報を、以下の各期間保有することがあります。

法的請求を立証し、申し立て又は防御するために必要となる情報 – 当該目的のため、上記第3項（お客様の個人情報の利用方法及び利用目的）に規定する目的のために必要がなくなった日から7年間、お客様の情報を保有します。
当社の提携先保険会社を通じてお客様又はお客様の雇用者が購入した保険商品に関する情報－各保険契約に関する情報は、お客様又はお客様の雇用者が当該契約を終了させてから6年間保有します。
保険商品と関係のないお客様の当社との連絡及びやり取りに関する情報 – 最大12ヶ月間保有します。
お客様のYuLifeプラットフォームへの登録及びその利用（当社のリワークプログラムの利用を含みます。）に関する情報 – お客様がYuLifeプラットフォームを12ヶ月間利用せず、お客様の保険契約が終了している場合、当該情報は、12ヶ月の未利用期間が満了した時点で直ちに消去されます。

保有の例外:

上記の保有期間にかかわらず、当社は、以下に該当する場合にお客様の個人情報を保有又は削除することがあります。

法令によって当社がお客様の個人情報をより長期間保有することを義務付けられる場合又はより早期に削除することを義務付けられる場合。
お客様が情報の消去を求める権利を行使され、当社が当該情報を保有することが法令に基づき許容又は義務付けられていない場合（下記第8項（お客様の権利）をご参照ください）。
お客様が、当社が定める保有期間を超えてお客様の個人情報を保有することを求める権利を行使された場合（下記第8項（お客様の権利）をご参照ください）。

7. セキュリティ及び他のサイトへのリンク

当社は、お客様が当社に提供した個人情報を保護し、不正なアクセス、不正な処理、不慮の損失、破棄及び損害を防止するためのセキュリティ措置を講じています。すべてのデータはTLS1.2以上で送信され、保存データはAES256を最低水準として暗号化されます。また、当社は、外部の安全な暗号化ファイル共有プラットフォームを活用しており、暗号化キーは、業界のベストプラクティスに従って管理されています。当社がお客様に対してYuLifeプラットフォームへのアクセスを可能とするパスワードを付与した場合（又はお客様がパスワードを設定した場合）、お客様は、お客様の責任で当該パスワードを安全かつ秘密に保管するものとし、第三者にこれを使用させないものとします。

残念ながら、インターネットを通じた情報の送信は、完全に安全なわけではありません。当社は、お客様の個人情報を保護するために可能な限りの手段を尽くしますが、個人情報がオンラインで当社に送信された場合の安全性を保証することはできません。お客様は、インターネットを利用することに内在するセキュリティ上の問題を了承し、当社の責に帰すべき事由がある場合を除き、セキュリティ侵害について当社の責任を問わないものとします。

お客様が公衆の場でコンピューター又は端末を使用する場合、安全のため、オンラインでのセッションを完了した際に、常にログアウトし、ウェブサイトブラウザを閉じることをお勧めします。また、お客様のオンライン上での安全性を強化するため、以下のセキュリティ措置を講じることをお勧めします：

パスワードを作成する場合、最低でも8文字で、文字と数字を組み合わせたものを使用すること。
パスワードを頻繁に変更すること。
パスワードは公言しないこと。お客様のパスワードを知っている人は、誰でもお客様のアカウントにアクセスできることを忘れないでください。
複数のオンライン上のアカウントについて同じパスワードを使用しないこと。
当社が電子メールによってお客様にアカウント又はクレジットカード情報を確認すること求めることは一切ありません。もし、YuLifeを騙って上記情報を求める電子メールを受領した場合、無視し、回答しないようにしてください。

YuLifeプラットフォーム内には、当社の管理下にない組織によって運営されるウェブサイトへのリンクが含まれていることがあります。本プライバシーポリシーは、これらのウェブサイトには適用されませんので、当該ウェブサイトのプライバシーポリシーを読まれことをお勧めします。当社は、（当社が提供したリンクを用いてアクセスした場合であっても）他のウェブサイトのプライバシーポリシー及び運用について責任を負わず、お客様への情報提供及びお客様の便宜のためにのみ、これらのウェブサイトへのリンクを提供するに過ぎません。当社は、他のウェブサイトのコンテンツ、プライバシー保護及び利用規約について明示的に責任を否定し、他のウェブサイトの正確性、コンテンツ又は完全性について何らの推薦、表明又は確約も行いません。お客様の外部ウェブサイトへの個人情報の開示は、お客様の自己責任で行われことをご了承ください。

また、お客様が他のウェブサイトからYuLifeプラットフォームにリンクされた場合、当社は、当該ウェブサイトの所有者及び運営者のプライバシーポリシー及び運用について責任を負いませんので、お客様ご自身で当該ウェサイトのプライバシーポリシーを確認することをお勧めします。

8. お客様の権利

お客様には、お客様の個人情報に関し、データ保護法令に基づき様々な権利がございます。お客様の権利行使に関連して、お客様の身元を確認するため、又は、お客様の個人情報を検索するため、当社はお客様に追加して情報提供を求めることがあります。例外的な場合を除き、当社は、以下のいずれかの日から1歴月以内に、お客様のご依頼に対応します。

お客様の身元を確認できた日。
当社が追加の情報提供を受ける必要がない場合、お客様からのご依頼を受けた日。

お客様は以下の権利を有していますが、一定の状況でのみ適用されるものもあります。

9. 本プライバシーポリシーの変更

当社は、随時本プライバシーポリシーを見直すことがあります。本プライバシーポリシーの変更があった場合には、当社のウェブサイト及び／若しくはYuLifeプラットフォーム上に更新版を掲載し、並びに／又は、電子メールで連絡することにより、お客様に対してお知らせします。本プライバシーポリシーの変更は、当社の電子メールの日付又は当社がYuLifeプラットフォーム若しくは当社のウェブサイト上に更新版を掲載した日付のうち、いずれか早い方の日から7日後に効力が発生するものとします。お客様が更新後の本プライバシーポリシーのいずれかの部分にご同意いただけない場合、直ちに当社までご連絡いただく必要がございます。

本プライバシーポリシー又は当社のお客様の個人情報の処理に関する問合せは、以下の連絡先情報を用いて、当社のData Protection Officer宛にお願いします。

We are on a mission to promote healthier lifestyles. We are a provider of wellbeing and employee engagement and rewards all in one platform.

why and how we may use the personal information that we have obtained from interactions you (or others) may have with us as a business, including when you use our services, visit and use our mobile app (YuLife App), visit and use the ‘Member’ and ‘HR’ portals on our website (currently located https://japan.yulife.com/saas) (YuLife Portals) (YuLife App and YuLife Portals together, the YuLife Platforms) or when you contact us;

the rights you have in connection with the information we use.

2. PERSONAL INFORMATION WE COLLECT ABOUT YOU

We collect personal information from you in the following ways:

This is personal information you give to us when you:

register or subscribe to use our services (including the YuLife Platforms);
interact with and use any of our services (including the YuLife Platforms);
contact us via email, telephone or use the chat functionality on our website.

This personal information is provided by you entirely voluntarily and includes personal information you provide via the YuLife Platforms. We may also ask you for information when you report a problem relating to the YuLife Platforms.

The information you give to us may include:

Contact information – your name, work email address, secondary email address, date of birth, home address, telephone number and other information that enables us to contact you;
Employment information – your company/employer’s name, employer’s address, employee number, and other information relating to your employment;
Activity information – your step-count, the ‘Yumoji’ you create in the YuLife App and other information collected directly from your devices via the YuLife App (e.g. via Samsung Health);
Rewards information – information relating to any rewards you redeem using YuCoin;
Survey and questionnaire response information – your response(s) to our surveys and questionnaires, which may include the disclosure of special category data;
Enquiries information – information included with and relating to your contact/enquiries; and
Device information – your geolocation information (taken through your mobile device’s GPS signal or WIFI signal), IP address, MAC address and other information collected from your mobile device

If we do not receive this information, you may be unable to use or interact with certain parts of the YuLife Platforms, make full use of our services, or communicate with us effectively.

Personal information we collect about you:

We may automatically collect information about your use of the YuLife Platforms, such as the number and duration of your visits to the YuLife Platforms and details of which particular pages have been visited. We will pseudonymise this information so that it is not attributable to you (Pseudonymised Information).

We also automatically collect technical information, including anonymous data collected by the hosting server for statistical purposes, the Internet protocol (IP) address used to connect your computer or device to the Internet, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform as well as cookie, tracking pixel and beacon identification information and other information collected from your devices (Technical Information). Please see our Website Privacy Policy and our Cookies Policy for further information.

We use any collected Technical Information and Pseudonymised Information to analyse how the YuLife Platforms are functioning and how they are used by users, for insight purposes and to help us maintain and improve the YuLife Platforms on an ongoing basis.

Information we collect about you from other sources:

We may obtain the following personal information about you from the following sources in compliance with the Act on the Protection of Personal Information and other applicable laws (Data Protection Laws), which we use in the ways described in the section below:

Information we share within the YuLife group:

We may share the personal information set out in this paragraph 2 with YuLife group companies for the purposes described in paragraph 3 (below). For the purposes of this Privacy Policy, a YuLife group company means any company which is wholly owned (whether directly or ultimately) by YuLife Holdings Ltd (a company registered in the United Kingdom). When YuLife shares your Personal Data with YuLife group companies, YuLife shall be the entity that is responsible for processing and managing your personal information. YuLife’s official address is as listed in Paragraph 1 (above) and its representative is Sam Fromson.

3. HOW AND WHY WE USE YOUR PERSONAL INFORMATION

The purposes for which we use your personal information and (where relevant) the lawful bases on which we rely, is as follows:

When sending your information to Suppliers, we only disclose to them any personal information that is necessary for them to provide their service to us and we have a contract in place that requires them to keep your information secure and not to use it other than in accordance with our specific instructions.

When we share your personal information with any third parties that are controllers of that information, they may disclose or transfer it to other organisations in accordance with their data protection policies. This does not affect any of your data subject rights as detailed below. In particular, where you ask us to rectify, erase or restrict the processing of your information, we take reasonable steps to pass this request on to any such third parties with whom we have shared your personal information.

We may disclose your personal information to other third parties as follows:

any third party who is restructuring, selling or acquiring some or all of our business or assets or otherwise in the event of a merger, re-organisation or similar event; and
if we are under a duty to disclose or share your information in order to comply with any legal or regulatory obligation or request, including by the police, tribunals, regulators, the government or related agencies.

5. WHERE WE STORE YOUR PERSONAL INFORMATION

Where permitted by Data Protection Laws, we may transfer your personal information to jurisdictions outside Japan for the purposes set out in this privacy policy. We will implement appropriate safeguards to secure the transfer of your personal information to jurisdictions outside Japan. These safeguards include:

relying on declarations made by regulators or governments (e.g. adequacy decisions/regulations)
where the third country where data is being sent is not subject to such declaration, the standard contractual clauses approved by relevant regulators or governments, as applicable;
ensuring that the recipients are subscribed to international frameworks; or
such alternative measures as are valid and appropriate at the time.

If you use our services whilst you are outside Japan, your information may be transferred outside those territories in order to receive those services.

6. THE PERIOD FOR WHICH WE KEEP YOUR PERSONAL INFORMATION

If we collect your personal information, the length of time for which we retain it is determined by a number of factors including the purpose for which we use that information and our obligations under Data Protection Laws. We do not retain personal information in an identifiable format for longer than is necessary.

Unless the exceptions outlined below apply, we may retain the following personal information, for the following periods:

information we need to establish, bring or defend legal claims – for this purpose we will retain your information for 7 years after the date it is no longer needed by us for any of the purposes listed under paragraph 3 (How and why we use your personal information) above;
information about or relating to insurance products that you or your employer purchase via our insurer partners – the information relating to each insurance policy will be retained for 6 years following the cancellation of such policy by you or your employer;
information relating to your communications and correspondence with us that does not relate to any insurance product – this information will be retained for a maximum period of 12 months; and
information relating to your registration and use of the YuLife Platforms (including your use of our rewards program) – if you do not use the YuLife Platforms for a period of 12 months and your insurance policy has been cancelled, this information will be deleted immediately upon expiry of the 12 month non-use period.

Retention exceptions:

Not withstanding the above retention periods, we may retain or delete your personal information where:

the law requires us to hold your personal information for a longer period, or delete it sooner;
you exercise your right to have the information erased (where it applies) and we do not need to hold it in connection with any of the reasons permitted or required under the law (see paragraph 8 (Your Rights) below); or
you exercise your right to require us to retain your personal information for a period longer than our stated retention period (see paragraph 8 (Your Rights) below).

7. SECURITY AND LINKS TO OTHER SITES

We employ security measures to protect the personal information you provide to us, to prevent access by unauthorised persons and unlawful processing, accidental loss, destruction and damage. All data is to be transmitted over TLS1.2 or greater, and data storage at rest is to be encrypted to a minimum standard of AES256. We also utilise a third party secure encryption file sharing platform. Encryption keys are managed as per industry best practice. When we have provided (or you have chosen) a password allowing you access to certain parts of the YuLife Platforms, you are responsible for safeguarding it and keeping it confidential and you promise not to allow it to be used by third parties.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do everything possible to protect your personal information, we cannot guarantee the security of any personal information during its transmission to us online. You accept the inherent security implications of using the internet and will not hold us responsible for any breach of security unless we are at fault.

If you are using a computer or terminal in a public location, we recommend that you always log out and close the website browser when you complete an online session for your security.
