YuLifeへようこそ。日本で設立された会社であるYuLife Japan合同会社（会社法人等番号：0100-03-044277）（登録住所：東京都千代田区内幸町2丁目2番2号富国生命ビルA&Sフィナンシャルアドバイザリー株式会社内）（以下「当社」又は「YuLife」といいます。）は、貴方のプライバシーを保護し、尊重することをお約束します。当社の使命は、より健康的なライフスタイルを奨励することです。当社は、福利厚生並びに従業員のエンゲージメント及びリワードをすべて同一のプラットフォーム上で提供します。

このプライバシーポリシーは、以下の事項について説明します。

貴方が当社のサービスを利用した場合、当社のモバイルアプリ（以下「YuLifeアプリ」といいます。）を訪問し、利用した場合、当社のウェブサイト（現在のアドレスはwww.yulife.com）上の「メンバー」及び「HR」ポータル（以下「YuLifeポータル」といい、YuLifeアプリとYuLifeポータルを総称して「YuLifeプラットフォーム」といいます。）を訪問し、利用した場合又は貴方が当社に連絡した場合等、貴方（又はその他の方）が事業者である当社とやり取りを行う際に当社が取得した個人情報を利用する目的及び方法。

当社が貴方の個人情報の管理者となります。これは、貴方の個人情報の処理目的及び方法を当社が決定することを意味します。当社の連絡先及び法的情報については、本プライバシーポリシーの末尾の項目をご覧ください。

2. 当社が貴方について収集する個人情報

当社は、以下の方法で貴方から個人情報を収集します。

貴方が当社に対して提供する個人情報

これは、貴方が以下の行為を行う場合に当社に提供する個人情報です。

当社のサービス（YuLifeプラットフォームを含みます。）を利用するための登録又は申込み。
当社のサービス（YuLifeプラットフォームを含みます。）とのやり取り及び利用。
電子メール、電話又は当社のウェブサイト上のチャット機能を利用した当社への連絡。

これらの個人情報は、YuLifeプラットフォームを通じて貴方が提供する個人情報を含め、完全に貴方から任意に提供されるものです。また、当社は、貴方がYuLifeプラットフォームに関する問題を報告する際に情報を依頼することがあります。

貴方が当社に提供する情報には、以下のものが含まれます。

連絡先情報 – 貴方の氏名、職場の電子メールアドレス、二次的な電子メールアドレス、生年月日、自宅住所、電話番号及び当社が貴方に連絡取るために必要となるその他の情報。
雇用情報 – 貴方の会社／雇用者の名前、雇用者の住所、従業員番号及び貴方の雇用に関するその他の情報。
活動情報 – 貴方のステップカウント、YuLifeアプリ内で貴方が作成する「Yumoji」及びYuLifeアプリを通じて（例えばSamsung Healthを通じて）貴方のデバイスから直接収集されるその他情報。
リワード情報 – 貴方がYuCoinを利用して引き換えたリワードに関する情報。
調査及びアンケート回答情報 –当社の調査及びアンケートに対する回答（特別カテゴリーのデータの開示が含まれることがあります。）。
問合せ情報 – 貴方の連絡／問合せに含まれ、又はこれに関連する情報。
デバイス情報 – （貴方のモバイルデバイスのGPS信号又はWIFI信号から取得される）貴方のジオロケーション情報、IPアドレス、MACアドレス及び貴方のモバイルデバイスから収集されるその他の情報。

当社がこれらの情報を取得できない場合、貴方は、YuLifeプラットフォームの特定の部分の利用ややり取りを行えず、当社のサービス全部の利用を利用できず、又は当社と効果的に連絡を取ることができないことがあります。

当社が貴方について収集する情報

当社は、貴方のYuLifeプラットフォームへの訪問回数及び滞在時間、貴方がどのページを訪問したかについての詳細情報等、貴方のYuLifeプラットフォームの利用に関する情報を自動的に収集することがあります。当社は、これらの情報が貴方に紐付けられないよう、これらの情報を匿名化します（以下「匿名化された情報」といいます。）。

また、当社は、統計目的でホストサーバーが収集する匿名データ、貴方のコンピューター又はデバイスをインターネットに接続するために利用されたインターネットプロトコル（IP）アドレス、ブラウザの種類及びバージョン、タイムゾーン設定、ブラウザのプラグインの種類及びバージョン、OS及びプラットフォーム、並びに、クッキー、トラッキングピクセル及びビーコン検知情報及び貴方のデバイスから収集されるその他の情報を含む技術的な情報（以下「技術情報」といいます。）を自動的に収集します。詳細な情報については、当社のウェブサイトプライバシーポリシー及びクッキーポリシーをご覧ください。

当社は、収集した技術情報及び匿名化された情報を、YuLifeプラットフォームがどのように作動し、どのようにユーザーに利用されているかを分析するため、洞察目的、並びに、YuLifeプラットフォームを継続的に維持及び改善するために利用します。

当社が貴方についてその他の情報源から収集する情報

当社は、個人情報の保護に関する法律及びその他の適用法令（以下「データ保護法令」といいます。）に従い、貴方に関する以下の個人情報を以下の情報源から取得することがあり、これらの情報を次項に定める方法で利用します。

当社がYuLifeグループと共有する情報

当社は、以下の第3項に定める目的のために、この第2項に定める個人情報をYuLifeグループ会社と共有することがあります。本プライバシーポリシーにおいて、YuLifeグループ会社とは、YuLife Holdings Ltd（英国で登録された会社）の直接又は間接の完全子会社を意味します。YuLifeがYuLifeグループ会社と貴方の個人データを共有する場合、貴方の個人情報の処理及び管理についてはYuLifeが責任主体となるものとします。YuLifeの正式な住所は上記第1項に記載のとおりで、その代表者はSam Fromsonです。

3. 当社が貴方の個人情報を利用する方法及び目的

当社が貴方の個人情報を利用する目的及び（該当する場合の）当社が依拠する法的根拠は以下のとおりです。

上記のとおり、当社が法的根拠として同意に依拠している場合、貴方は、いつでも、当社が上記のいずれかの方法で貴方の情報を利用することに対する同意を撤回できます。詳細については、第8項（貴方の権利）をご参照ください。

4. 当社による貴方の個人情報の開示

当社は、上記の目的のために、当社の外部サービスプロバイダー、エージェント及び再委託先（以下「本サプライヤー」といいます。）に対し、貴方の情報を開示することがあります。本サプライヤーは、以下のとおり分類されます。

貴方の情報を本サプライヤーに提供する場合、当社は、当該本サプライヤーが当社に対して提供するサービスのために必要な個人情報に限って開示するものとします。当社は、本サプライヤーとの間で、本サプライヤーが貴方の情報を安全に保管すること、当社の具体的な指示に従う場合以外には当該情報を使用しないことを義務付ける契約を締結しています。

当社が貴方の個人情報を当該情報の管理者となる第三者との間で共有する場合、当該第三者は、当該第三者のデータ保護ポリシーに従って当該情報を他の組織に開示又は移転することがあります。これにより、以下に詳述する貴方のデータ主体としての権利は影響を受けません。具体的には、貴方が当社に対して貴方の情報の修正、消去又は処理の制限を求めた場合、当社は、当社が貴方の個人情報を共有した第三者に対して当該要請を伝達するよう合理的な措置を講じます。

当社は、以下のとおり、その他の第三者に貴方の個人情報を開示することがあります。

当社の事業若しくは資産の一部若しくは全部を再編、売却若しくは取得する第三者、又はその他合併、組織再編若しくは類似の事象の場合。
警察、裁判所、規制当局、政府又はこれらに関連する期間からの要請があった場合を含め、法令上又は規制上の義務又は要請を遵守するために、当社が貴方の情報を開示又は共有しなければならない場合。

5. 当社による貴方の個人情報の保管

データ保護法令によって許容される場合、当社は、本プライバシーポリシーに定める目的のために、貴方の個人情報を日本以外の地域に移転することがあります。当社は、貴方の個人情報の日本以外の地域への移転を安全に行うために適切な安全措置を講じます。これらの安全措置には以下が含まれます。

規制当局又は政府が行う宣言（十分性認定、規制等）に依拠する。
データが送られる第三国が当該宣言の対象とされていない場合、該当する場合に応じて、関連規制当局又は政府によって承認された標準契約条項。
受領者が国際的なフレームワークに加盟していることを確認する。
その時点で有効かつ適切な代替措置。

当社が講じる措置についてより詳細な情報を希望される場合及び関連書類を入手されたい場合、本プライバシーポリシーの末尾に記載する情報を使って当社にご連絡ください。

貴方が日本国外に滞在中に当社のサービスを利用する場合、貴方の情報は、当該サービスの提供を受けるために当該地域の外に移転されることがあります。

6. 当社が貴方の個人情報を保管する期間

貴方の個人情報を収集する場合、当社が当該個人情報を保有する期間は、当社における当該情報の利用目的、データ保護法令上の当社の義務等、様々な要因によって決まります。当社は、必要な期間を超えて、個人情報を識別可能な体裁で保有することはありません。

以下に概略が記載される例外に該当する場合を除き、当社は、以下の個人情報を以下の期間中保有することがあります。

法的請求を立証し、申し立て又は防御するために必要となる情報 – 当該目的のため、当社は、上記第3項（当社が貴方の個人情報を利用する方法及び目的）に規定する目的のために当社が必要としなくなった日から7年間、貴方の情報を保有します。
当社の提携先保険会社を通じて貴方又は貴方の雇用者が購入した保険商品に関する情報－各保険契約に関する情報は、貴方又は貴方の雇用者が当該契約を終了させてから6年間保有されます。
保険商品と関係のない貴方の当社との連絡及びやり取りに関する情報 – 当該情報は、最大12ヶ月間保有されます。
貴方のYuLifeプラットフォームへの登録及びその利用（当社のリワークプログラムの利用を含みます。）に関する情報 – 貴方がYuLifeプラットフォームを12ヶ月間利用せず、貴方の保険契約が終了している場合、当該情報は、12ヶ月の不利用期間が満了した時点で直ちに消去されます。

保有の例外:

上記の保有期間にかかわらず、当社は、以下の場合に貴方の個人情報を保有又は削除することがあります。

法令によって当社が貴方の個人情報をより長い期間保有しなければならない場合又はより早く削除しなければならない場合。
(該当する場合に）貴方が情報の消去を求める権利を行使し、法令に基づき許容又は必要とされる理由に関連して当社が当該情報を保有する必要がない場合（下記第8項（貴方の権利）をご参照ください）。
貴方が、当社に対し、当社が定める保有期間を超えて貴方の個人情報を保有することを求める権利を行使した場合（下記第8項（貴方の権利）をご参照ください）。

7. セキュリティ及び他のサイトへのリンク

当社は、貴方が当社に提供した個人情報を保護し、権限のない者によるアクセス及び不正な処理、不慮の損失、破棄及び損害を防止するためのセキュリティ措置を講じています。すべてのデータはTLS1.2以上で送信され、保存データはAES256を最低水準として暗号化されるものとします。また、当社は、外部の安全な暗号化ファイル共有プラットフォームを活用しています。暗号化キーは、業界のベストプラクティスに従って管理されています。当社が貴方に対してYuLifeプラットフォームの特定の部分へのアクセスを可能とするパスワードを付与した場合（又は貴方が当該パスワードを選択した場合）、貴方は、貴方の責任で当該パスワードを安全かつ秘密に保管するものとし、第三者にこれを使用させないことを約束します。

残念ながら、インターネットを通じた情報の送信は、完全に安全なわけではありません。当社は、貴方の個人情報を保護するために可能な限りの手段を尽くしますが、個人情報がオンラインで当社に送信された場合の安全性を保証できません。貴方は、インターネットを利用することに内在するセキュリティ上の問題を了承し、当社の責に帰すべき事由がある場合を除き、セキュリティ侵害について当社の責任を問わないものとします。

貴方が公衆の場でコンピューター又は端末を使用する場合、安全のため、オンラインでのセッションを完了した際に、常にログアウトし、ウェブサイトブラウザを閉じることをお勧めします。また、貴方のオンライン上での安全性を強化するため、以下のセキュリティ措置を講じることをお勧めします：パスワードを作成する場合、最低でも8文字で、文字と数字を組み合わせたものを使用することをお勧めします。パスワードを頻繁に変更することをお勧めします。パスワードは公言しないでください。貴方のパスワードを知っている人は、誰でも貴方のアカウントにアクセスできることを忘れないでください。複数のオンライン上のアカウントについて同じパスワードを使用することは避けてください。当社が電子メールによって貴方にアカウント又はクレジットカード情報を確認すること求めることは一切ありません。もし、YuLifeであると名乗って上記を求める電子メールを受領した場合、無視し、回答しないようにしてください。

YuLifeプラットフォーム内には、当社がコントロールしていない他の組織によって運営される他のウェブサイトへのリンクが含まれていることがあります。本プライバシーポリシーは、これらの他のウェブサイトには適用されませんので、他のウェブサイトのプライバシーポリシーを読むことをお勧めします。当社は、（当社が提供したリンクを使ってアクセスした場合であっても）他のウェブサイトのプライバシーポリシー及び活動について責任を負わず、貴方への情報提供及び貴方の便宜のためにのみ、これらのウェブサイトへのリンクを提供しているに過ぎません。当社は、他のウェブサイトのコンテンツ、プライバシー実務及び利用規約について明示的に責任を否定し、他のウェブサイトの正確性、コンテンツ又は完全性について何らの推薦、表明又は確約も行いません。貴方の外部のウェブサイトへの個人情報の開示は、自己責任で行われるものです。

また、貴方が外部のウェブサイトからYuLifeプラットフォームにリンクした場合、当社は、当該外部ウェブサイトの所有者及び運営者のプライバシーポリシー及び活動について責任を負えませんので、貴方自身で当該外部ウェサイトのポリシーを確認することをお勧めします。

8. 貴方の権利

貴方は、貴方の個人情報に関し、データ保護法令に基づき様々な権利を有しています。一定の権利に関連して、貴方の身元を確認するため、又は、該当する場合には、貴方の個人情報を検索するため、当社は貴方に情報提供を求めることがあります。例外的な場合を除き、当社は、以下のいずれかの日から1歴月以内に回答します。

当社が貴方の身元を確認できた日。
当社が上記情報を既に保有しているため上記を行う必要がない場合、当社が貴方からの要請を受けた日。

貴方は以下の権利を有していますが、一定の状況でのみ適用されるものもあります。

9. 本プライバシーポリシーの変更

当社は、随時本プライバシーポリシーを見直すことができるものとし、変更があった場合には、当社のウェブサイト及び／若しくはYuLifeプラットフォーム上に更新版を掲載し、並びに／又は、電子メールで連絡することにより、貴方に対して通知します。当該変更は、当社の電子メールの日付又は当社がYuLifeプラットフォーム若しくは当社のウェブサイト上に修正版を掲載した日付のうち、いずれか早い方の日から7日後に効力が発生するものとします。更新後の本プライバシーポリシーのいずれかの部分に同意できない場合、貴方は直ちに当社に通知しなければなりません。

why and how we may use the personal information that we have obtained from interactions you (or others) may have with us as a business, including when you use our services, visit and use our mobile app (YuLife App), visit and use the ‘Member’ and ‘HR’ portals on our website (currently located www.yulife.com) (YuLife Portals) (YuLife App and YuLife Portals together, the YuLife Platforms) or when you contact us;

2. PERSONAL INFORMATION WE COLLECT ABOUT YOU

We collect personal information from you in the following ways:

This is personal information you give to us when you:

register or subscribe to use our services (including the YuLife Platforms);
interact with and use any of our services (including the YuLife Platforms);
contact us via email, telephone or use the chat functionality on our website.

This personal information is provided by you entirely voluntarily and includes personal information you provide via the YuLife Platforms. We may also ask you for information when you report a problem relating to the YuLife Platforms.

The information you give to us may include:

Contact information – your name, work email address, secondary email address, date of birth, home address, telephone number and other information that enables us to contact you;
Employment information – your company/employer’s name, employer’s address, employee number, and other information relating to your employment;
Activity information – your step-count, the ‘Yumoji’ you create in the YuLife App and other information collected directly from your devices via the YuLife App (e.g. via Samsung Health);
Rewards information – information relating to any rewards you redeem using YuCoin;
Survey and questionnaire response information – your response(s) to our surveys and questionnaires, which may include the disclosure of special category data;
Enquiries information – information included with and relating to your contact/enquiries; and
Device information – your geolocation information (taken through your mobile device’s GPS signal or WIFI signal), IP address, MAC address and other information collected from your mobile device

If we do not receive this information, you may be unable to use or interact with certain parts of the YuLife Platforms, make full use of our services, or communicate with us effectively.

Personal information we collect about you:

We may automatically collect information about your use of the YuLife Platforms, such as the number and duration of your visits to the YuLife Platforms and details of which particular pages have been visited. We will pseudonymise this information so that it is not attributable to you (Pseudonymised Information).

We also automatically collect technical information, including anonymous data collected by the hosting server for statistical purposes, the Internet protocol (IP) address used to connect your computer or device to the Internet, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform as well as cookie, tracking pixel and beacon identification information and other information collected from your devices (Technical Information). Please see our Website Privacy Policy and our Cookies Policy for further information.

We use any collected Technical Information and Pseudonymised Information to analyse how the YuLife Platforms are functioning and how they are used by users, for insight purposes and to help us maintain and improve the YuLife Platforms on an ongoing basis.

Information we collect about you from other sources:

We may obtain the following personal information about you from the following sources in compliance with the Act on the Protection of Personal Information and other applicable laws (Data Protection Laws), which we use in the ways described in the section below:

Information we share within the YuLife group:

We may share the personal information set out in this paragraph 2 with YuLife group companies for the purposes described in paragraph 3 (below). For the purposes of this Privacy Policy, a YuLife group company means any company which is wholly owned (whether directly or ultimately) by YuLife Holdings Ltd (a company registered in the United Kingdom). When YuLife shares your Personal Data with YuLife group companies, YuLife shall be the entity that is responsible for processing and managing your personal information. YuLife’s official address is as listed in Paragraph 1 (above) and its representative is Sam Fromson.

3. HOW AND WHY WE USE YOUR PERSONAL INFORMATION

The purposes for which we use your personal information and (where relevant) the lawful bases on which we rely, is as follows:

When sending your information to Suppliers, we only disclose to them any personal information that is necessary for them to provide their service to us and we have a contract in place that requires them to keep your information secure and not to use it other than in accordance with our specific instructions.

When we share your personal information with any third parties that are controllers of that information, they may disclose or transfer it to other organisations in accordance with their data protection policies. This does not affect any of your data subject rights as detailed below. In particular, where you ask us to rectify, erase or restrict the processing of your information, we take reasonable steps to pass this request on to any such third parties with whom we have shared your personal information.

We may disclose your personal information to other third parties as follows:

any third party who is restructuring, selling or acquiring some or all of our business or assets or otherwise in the event of a merger, re-organisation or similar event; and
if we are under a duty to disclose or share your information in order to comply with any legal or regulatory obligation or request, including by the police, tribunals, regulators, the government or related agencies.

5. WHERE WE STORE YOUR PERSONAL INFORMATION

Where permitted by Data Protection Laws, we may transfer your personal information to jurisdictions outside Japan for the purposes set out in this privacy policy. We will implement appropriate safeguards to secure the transfer of your personal information to jurisdictions outside Japan. These safeguards include:

relying on declarations made by regulators or governments (e.g. adequacy decisions/regulations)
where the third country where data is being sent is not subject to such declaration, the standard contractual clauses approved by relevant regulators or governments, as applicable;
ensuring that the recipients are subscribed to international frameworks; or
such alternative measures as are valid and appropriate at the time.

If you use our services whilst you are outside Japan, your information may be transferred outside those territories in order to receive those services.

6. THE PERIOD FOR WHICH WE KEEP YOUR PERSONAL INFORMATION

If we collect your personal information, the length of time for which we retain it is determined by a number of factors including the purpose for which we use that information and our obligations under Data Protection Laws. We do not retain personal information in an identifiable format for longer than is necessary.

Unless the exceptions outlined below apply, we may retain the following personal information, for the following periods:

information we need to establish, bring or defend legal claims – for this purpose we will retain your information for 7 years after the date it is no longer needed by us for any of the purposes listed under paragraph 3 (How and why we use your personal information) above;
information about or relating to insurance products that you or your employer purchase via our insurer partners – the information relating to each insurance policy will be retained for 6 years following the cancellation of such policy by you or your employer;
information relating to your communications and correspondence with us that does not relate to any insurance product – this information will be retained for a maximum period of 12 months; and
information relating to your registration and use of the YuLife Platforms (including your use of our rewards program) – if you do not use the YuLife Platforms for a period of 12 months and your insurance policy has been cancelled, this information will be deleted immediately upon expiry of the 12 month non-use period.

Retention exceptions:

Not withstanding the above retention periods, we may retain or delete your personal information where:

the law requires us to hold your personal information for a longer period, or delete it sooner;
you exercise your right to have the information erased (where it applies) and we do not need to hold it in connection with any of the reasons permitted or required under the law (see paragraph 8 (Your Rights) below); or
you exercise your right to require us to retain your personal information for a period longer than our stated retention period (see paragraph 8 (Your Rights) below).

7. SECURITY AND LINKS TO OTHER SITES

We employ security measures to protect the personal information you provide to us, to prevent access by unauthorised persons and unlawful processing, accidental loss, destruction and damage. All data is to be transmitted over TLS1.2 or greater, and data storage at rest is to be encrypted to a minimum standard of AES256. We also utilise a third party secure encryption file sharing platform. Encryption keys are managed as per industry best practice. When we have provided (or you have chosen) a password allowing you access to certain parts of the YuLife Platforms, you are responsible for safeguarding it and keeping it confidential and you promise not to allow it to be used by third parties.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do everything possible to protect your personal information, we cannot guarantee the security of any personal information during its transmission to us online. You accept the inherent security implications of using the internet and will not hold us responsible for any breach of security unless we are at fault
